By using Hexplora.earth, or any of the Hexplora mobile apps, you agree to the following Terms of Service, which constitute an agreement between you and Hexplora. Hexplora is owned by Hexplord (Pty) Ltd. (registration 2025/573797/07), a limited liability company operating under the laws of the Republic of South Africa.

1. No warranty

   Hexplora.earth, and the Hexplora apps, make no warranties regarding the accuracy, completeness, or performance of the data represented therein.

2. Activity data

   • Real GPS tracking data

     You agree that when uploading activities to Hexplora, via your linked Strava account, you will only use real GPS data from activities that you personally recorded with a GPS device such as your mobile phone, a smart watch, or a fitness tracking device.

   • Human-powered activities

     You agree that you will only upload GPS data from activities that were performed by yourself, powered with your own muscles, gravity (e.g. alpine skiing), or with wind power (e.g. sailing boat, windsurfing, kitesurfing). The use of an electric pedal bicycle is permitted.

   • No altering of activities.

     You agree that you won’t artificially enhance an activity’s path, distance, duration, speed, or any other of its original parameters as recorded by the GPS device that was the source of this data. If, however, you finish an activity, jump into your car and drive home, while accidently continuing to record the activity, cropping this activity would be permitted (and encouraged!).

3. Activity data content

   You agree that when using hexplora.earth or the Hexplora apps, you will not post, upload, transmit, distribute, store, create, publish or otherwise make available on the hexplora.earth any of the following:
   • Content that defames, abuses, harasses, stalks, threatens or otherwise violates the legal rights (such as rights of privacy or publicity) of others.
   • Any inappropriate, profane, defamatory, obscene, indecent or unlawful topic, name, material or information.
   • User content (including images and text) protected by intellectual property laws, including copyright or trademark laws, unless you own the rights or have received a necessary consent to do the same.
   • User content that contains misleading, false, or inappropriate language or statements.
   In addition, you agree that when using hexplora.earth or the Hexplora apps, you will not:
   • Upload (including automated synchronisation from a fitness app) activity data that are not reasonably accurate representations of your own physical activities.
   • Artificially extend the activity distance, duration, speed, or any other of its parameters.
   • Harvest or otherwise collect information about others, including their activities, names, email addresses.
   • Use any material or information, including images or photographs, which are made available through hexplora.earth, in any manner that infringes any copyright, trademark, patent, trade secret, or other proprietary right of any party.

4. Security of your account

   You are entirely responsible for maintaining the confidentiality of your password and account. Furthermore, you are entirely responsible for any activities that occur under your account. We will not be liable for any loss that you may incur as a result of someone else using your password or account, even without your knowledge.

   You may not use anyone else’s account at any time, without the permission of the account holder.

5. Intellectual Property Rights

   You agree that hexplora.earth and the Hexplora apps contain proprietary information that is protected under South African and international intellectual property laws, including the laws of copyright and trademark. You agree not to sell, rewrite, modify, redistribute, create derivative works from the hexplora.earth website or the Hexplora apps content in whole or in part.

   Any use of third party trademarks within the hexplora.earth website or the Hexplora apps (such as Strava, Google, Facebook, Apple, Android, etc.) is for the purpose of describing products or services offered by the trademark owners and such trademarks are owned by the respective trademark owners, not by Hexplora.
